NUP security head Kivumbi denied bail

The head of security at the National Unity Platform headquarters in Makerere Kavule has applied for bail before the Makindye-based general court martial, where he is facing charges of unlawful possession of a military outfit.

Achleo Kivumbi was arrested, charged, and remanded to Luzira Upper Prison, where he has been in custody for over two months.

On Tuesday, Kivumbi, through his lawyers George Musisi , Benjamin Katana, Elizabeth Nyansingwa, and Kampala woman members of parliament Shamim Malende, applied for bail.

In his affidavit presented before the court chaired by Brig. Gen. Freeman Robert Mugabe, Kivumbi averred that bail is his constitutional right and the offence he is charged with is bailable before this court.

Musisi presented the application stating that Kivumbi has a fixed place of abode in Nansana East 11 Zone B and has substantial sureties who are ready to stand for him.

He presented his wife, Madinah Nabukenya, a nurse by profession, Francis Nakiganda Kivumbi, his sister, and his friend Kasim Jjumba, who is also the mayor of Nabweru Division in Wakiso district.

Musisi requested court to find merit in the application and grant the accused bail to look for his family and is ready to report wherever and whenever he is needed.

Prosecution represented by Lt Gift Mubehamwe requested court for an adjournment to the 29th of October to file their response for the application; however, this was objected to by the applicant’s lawyers, who said that they served prosecution a month ago, but it’s to the dismay that they ask for an adjournment to reply.

He was further remanded to October 15, 2024, for state to his application.

The charge

Kivumbi 42 is charged with one count of unlawful possession of a defence store contrary to Section 158(1)(2) and © of the UPDF Act, Cap. 330, and upon conviction, a maximum sentence is life imprisonment in prison.

Prosecution alleges that on August 3, 2024, while at Nansana East 11 Zone B in Wakiso District, a pair of Lieutenant Conel Pips gazettes for the defence forces was found.

He denied the charges, and the prosecution told the court that investigations are done and ready for hearing on October 18, 2024.
